DIET DRUG CASE: Judge Crittendon eyes fen-phen assets

By Michael Stevens

ADVERTISEMENTS
A special judge apparently intends to authorize fen-phen plaintiffs to go after the assets of companies associated with former attorneys Shirley Allen Cunningham Jr. and William Gallion, including sale of their interest in 2007 Horse of the Year Curlin.

The sudden development came during a hearing in a Frankfort civil lawsuit in which fen-phen plaintiffs are trying recover a $42 million judgment that was awarded last summer against Gallion, Cunningham and fellow attorney Melboure Mills Jr..

The three lawyers are scheduled to go on trial in federal court at Covington next month on criminal charges related to the fen-phen diet drug case.

During Wednesday's hearing, Special Judge Roger Crittenden said in answer to a question that he intends to enter an order sometime in the next few weeks that would allow the plaintiffs to go after the assets of the various limited liability companies controlled by Cunningham and Gallion.

That apparently would include Tandy LLC, whose subsidiary owns a 20 percent interest in Curlin, recent winner of the $6 million Dubai World Cup. The remaining 80 percent is owned by Jess Jackson's Stonestreet Stables.
