: New York Public Personnel LawUnion?s duty of fair representation
By Harvey Randall, Esq.
Union?s duty of fair representation
Mohammad Saidin and Local 2, UFT and the NYC Board of Education, PERB U26672
Mohammad Saidin alleged that the United Federation of Teachers Local 2 violated its duty of fair representation when it refused to process his grievance to Step 3 of the contract grievance procedure. PERB found that although Saidin established that he disagreed with the Federation?s refusal to process his grievance to a Step 3 hearing, merely disagreeing with the bargaining agent?s decision regarding its prosecuting a grievance is not enough to establish a breach of the duty of fair representation.
