Nine judges side with controversial ADA lawyer, but not enough

Nine judges on the 9th Circuit U.S. Court of Appeals sided with lawyer Thomas Frankovich in his fight to keep filing ADA lawsuits in California's Central District, The Recorder reported.

But it wasn't enough to get the court to take the case en banc.

Los Angeles Judge Edward Rafeedie barred Frankovich, who has filed at least 223 nearly identical ADA lawsuits in the Northern and Central districts, from filing disability access suits without court approval.

Chief Judge Alex Kozinski wrote in his dissent that the district should adopt a rule or general order that entrusts the vexatious litigant process to a committee of judges drawn at random.

Frankovich told The Recorder he was optimistic about an appeal to the U.S. Supreme Court.
