Your Legal Rights after an Accident and (PIP) Florida No Fault Insurance

Do you know your legal rights if you are involved in a motor vehicle accident under the Florida No Fault auto insurance law? The vast majority of injured accident victims do not fully understand their legal rights after being involved in a motor vehicle accident. Outlined below are steps that accident victims should follow, if involved in a personal injury accident:

  • Information Exchange - Do not discuss the accident with the other party, merely exchange registration and insurance information. Make sure the police are called to the scene.
  • Photos - If you have a camera in the car or on your cellular phone, take photographs of the car damage of all vehicles involved in the crash.
  • Medical Treatment - Be sure to get proper treatment right away, if injured.
  • Legal Advice - Call an attorney knowledgeable in motor vehicle accident law as soon as practicable to discuss your rights.
  • Your Personal Insurance - Report the accident to your own auto insurance company.
  • Other Party's Insurance - Do not report it to the other party's insurance company or discuss anything with any adjuster from the other vehicle's insurance company.

Florida No Fault Insurance Law

The only mandatory coverage in Florida is property damage and no-fault insurance (PIP) for payment of medical bills. Since liability insurance for injuries is not mandatory in Florida, it is important for you to make sure you protect yourself with sufficient insurance coverage. You should purchase liability insurance in as high an amount as you can afford with an equal amount of uninsured motorist coverage. Do Not Reject Uninsured Motorist Coverage as it protects you if the at-fault driver or vehicle has no liability insurance or minimum liability .

This is part one of a two part series on Florida No Fault Insurance (PIP- Personal Injury Protection Insurance).

As a Palm Beach Gardens Personal Injury Law Firm, this information is being provided to educate and inform Florida Drivers of their legal rights under Florida law. If you have any questions or comments regarding the information contained in this two part series, please contact an experienced Florida Personal Injury Lawyer to protect and preserve your legal rights.
