: Philip Brooks’ Patent Infringement UpdatesBusiness Methods: Patenting Computer and Machine Implemented Inventions Since Nuijten and Comiskey
By Philip Brooks
Charles R. Macedo of Amster, Rothstein & Ebenstein, LLP is going to be speaking at a webinar being sponsored by the World Research Group ("WRG") on February 14, 2008 at 12:00-1:15 EST titled, "Business Methods: Patenting Computer and Machine Implemented Inventions Since Nuijten and Comiskey."
Since the Nuijten (In re Nuijten, 2007 WL 2728397 [Fed. Cir. Sept. 20, 2007]) and Comiskey (In re Comiskey, 2007 WL 2728361 [Fed. Cir. Sept. 20, 2007]) decisions came down from the Federal Circuit in September 2007, the Board of Patent Appeals and Interferences has issued over a dozen decisions addressing the patentable subject matter of computer and machine implemented inventions. In many of the decisions, the Board of Patent Appeals and Interferences has raised for the first time new objections based on the claim not covering patentable subject matter. In this Webinar, Mr. Macedo will be addressing these issues. First, he will provide a background on the patentable subject matter issues, and the state of the law before Nuijten and Comiskey. Then, he will explain the Nuijten and Comiskey decisions. Mr. Macedo will also provide a detailed explanation of the common themes that are coming out of the Board of Patent Appeals and Interferences decisions since September 2007. Finally, he will discuss the implications of these decisions and provide guidance on how to draft claims in light of the current state of the law.
