By Anne Skove, Esq.
No, not the cool-coifed, alleged-love-child-fathering Edwards, we're talking about the one whose case went before the SCOTUS this past term.
Slate took a break from yakking about the former and gave some belated ink to the latter. A fresh spray of Cullen Seltzer claims that Indiana v. Edwards "hasn't gotten a lot of press," making us wonder what planet Slate reporters live on. Certainly, we travel in different circles.
But anyway, see Let Them Be Lawyers, Cullen Seltzer, Slate (July 29, 2008), for a look at the concept of dignity (or lack thereof) of individuals with mental illness in the Edwards majority and dissent. A very nice take on the case and the difficult issues.
See also Memo to SCOTUS: If a Defendant Is Spouting Gibberish at Trial, Maybe They Weren't Really Competent to Begin with, Scott Henson, Grits for Breakfast (March 27, 2008); How Will Edwards Affect Competency Evaluations?, Karen Franklin, Forensic Psychologist (June 29, 2008); There's Competency and There's Competency, Scott H. Greenfield, Simple Justice (June 20, 2008); and last + least, Sufficiently Uncertain: The Borderline Case of Indiana v. Edwards, court-o-rama (June 19, 2008). (None of which, apparently, were read by Seltzer.)
