Structured Asset Funding: Trade Secret Case - 1-2-3 Lump "Bummer"?

By John Darer

ADVERTISEMENTS

Following is a link to the Answer in the Structured Asset Funding Trade Secret case. Download SAF Lawsuit Answer. In the Answer, Defendant Marlon Oddo's answer and affirmative defenses make some serious allegations about the ethics of Structured Asset Funding and its principal officer,  President Michael Asseff, 37 of Hallandale, FL. Included among other things:

  • "Plaintiffs have solicited and hired employees from competitors, knowing these employees had signed non-compete agreements*,and did not respect the viability or enforceability of the competitor's non compete".
  • "Plaintiffs have created or permitted to exist, a hostile work environment in violation of the CIvil Rights Act of 1964 ("Title VIII"), as amended and the Florida Civil Rights Act ("FCRA"). Namely, Plaintiff's principal officer, Michael Asseff ("Asseff") hosted a company event at a a local restaurant at which a sales manager, Marc Hermes (who is also a high school fiend of Asseff), performed oral sex on a married accounting department employee, Renata Plewa, in public view. The company event then moved to a local strip club, where Asseff attempted to have sex with the same employee, but was unable to sexually perform. This conduct, which was condoned, sanctioned and participated in by Asseff in his capacity as principal officer of Plaintiffs created a hostile work environment in violation of Title VII and the FCRA"
  • " Plaintiffs have allowed, condoned and permitted Asseff to use marijuana on multiple occasions in the presence of and with employees, in violation of state and federal law".

We previously reported that Asseff has a felony record from 2005 for leaving the scene of an accident  Download Asseff 2005 Felony Broward

The answer does not specify when the alleged incident with Renata Plewa occurred but this author's research has uncovered a 2006 lawsuit styled Plewa v Structured Asset Services, LLC  U.S. District Court Southern District of Florida (Ft. Lauderdale)CIVIL DOCKET FOR CASE #: 0:06-cv-61887-CMA  filed under the Fair Labor Standards Act. It appears from public records that the lawsuit was terminated in April 2007 after a confidential settlement was reached at mediation. The attorney who then represented Ms. Plewa is representing Joshua C. Wander in the current lawsuit.

While SSP Director Rhonda Bentzen might feel such news is "trivial and inconsequential", let's reiterate that Michael Asseff is listed as a manager member of Bentzen Funding Solutions on its most recent annual report.
