Free With Registration: Southern District Civil Practice Roundup "Edward M. Spiro and Judith L. Mogul, principals of Morvillo, Abramowitz, Grand, Iason, Anello & Bohrer, analyze a trio of recent Southern District cases, all arising in the context of copyright infringement claims, that illustrate some of the considerations that influence whether a case will be transferred to another jurisdiction, and the importance of presenting the detailed and concrete facts supporting a motion to transfer."

International Arbitration Law " Emmanuel Gaillard, a partner at Shearman & Sterling and a Professor of Law at University of Paris XII, reviews a recent decision by the Amsterdam Court of Appeal granting leave to enforce in the Netherlands four arbitral awards issued by the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation in arbitral proceedings initiated by Yukos Capital SARL against OJSC Yuganskneftegaz. In refusing to recognize the decisions of the Russian courts which had set aside the arbitral awards, the Amsterdam Court of Appeal has firmly rejected any suggestion that its role as the enforcing court is a purely passive one. At the same time, the decision adds another voice to the growing chorus of international condemnation of the Russian judiciary in the Yukos affair."

OUTSIDE COUNSEL:
Avoiding Legal Malpractice: Dismissal and Their Remedies " Andrew Lavoott Bluestone, a sole practitioner in Manhattan, writes: Litigation is a back and forth set of tasks, requiring one side or the other to move forward, respond, or allow the litigation to end. The timing and performance of each step requires a response, and in its absence permits a potential dismissal. Remedies are available, and the skilled practitioner must understand both the problem and its solution. No remedy will be successful in all instances, but in almost every situation an affidavit of merits, with evidentiary support is preferred or necessary. Of course, in each case, a timely response or appearance eliminates any need for remedy."
