: Legal Pad | LAToledano and client indicted for extortion
By Richard Binder
James Toledano, the former chairman of Orange County's Democratic Party and a three-time Assembly candidate, has been indicted by an Orange County grand jury on two felony counts related to an alleged extortion scheme.
Toledano was representing Michael Earl Roberts, a former personal trainer who was also charged with the same felony counts. Roberts allegedly made dozens of harassing and threatening phone calls to a former client and her friends between 2006 and 2008 and threatened to sue her. Prosecutors say Roberts was going to have damaging stories printed about her in various media in order to "destroy" her. The woman filed a harassment suit in 2008.
Toledano allegedly met with the client's attorney and said that Roberts wanted $350,000 in exchange for not going to the press with those stories. Toledano's attorney, David E. Swanson, says that his client was merely trying to reach a settlement in the lawsuit.
