: Legal Pad | LAJudge orders pot dispensaries to close
By Richard Binder
Orange County Superior Court Judge David Chaffee ruled last week that 10 medical marijuana dispensaries in Lake Forest, having violated the city's municipal code, must close.
Chaffee rejected the dispensaries' claim that state law preempts municipal codes and noted that state law does not prohibit a city from enacting land use or zoning laws that affect dispensaries, citing recent decisions by California's 4th District Court of Appeal involving two other California cities.
The day after Chafee's ruling, one of those dispensaries, shut its doors voluntarily. Owner Shannon Saccullo said Earth Cann Wellness Center closed early "to show good faith to the city. We want to do everything the right way."
