: Legal Pad | LAConflict of interest ruled in Seyfarth malpractice case
By Richard Binder
Los Angeles County Superior Court Judge Mark Mooney has blocked Gibson, Dunn & Crutcher from representing Seyfarth Shaw in a malpractice case brought by Billy Blanks.
In a March 18 bench ruling, the judge determined that Gibson Dunn could not represent Blanks' former attorney, William Lancaster, formerly a Seyfarth Shaw partner, and Seyfarth Shaw at the same time. Mooney found Lancaster was Gibson Dunn's first client and that the firm had obtained neither a waiver of any potential conflicts of interest nor had appropriately withdrawn as Lancaster's attorney.
The lawsuit stemmed from a case in which Lancaster unsuccessfully represented Blanks against a former business associate. Blanks originally won a $30 million malpractice verdict against Seyfarth Shaw, including $15 million in punitive damages, after a jury decided that Lancaster had not filed court papers appropriately on Blanks' behalf. An appeals court threw out the $30 million verdict in February 2009.
