: Legal Pad | LACherry bombs and 'Cherry Bomb' will proceed in La Jolla
By Richard Binder
La Jolla Cove will get its fireworks show after all. Joan Jett, too.
Attorney Marco Gonzalez, representing the Coastal Environmental Rights Foundation, had been trying to have the fireworks show moved off the cove because the aerial explosions harmed the harbor seals and generally contaminated the water. His suit, filed last week, claimed San Diego city officials hadn't taken the necessary steps under the California Environmental Quality Act to protect against the possibility of irreparable environmental harm.
San Diego Superior Court Judge Linda Quinn today ruled against the suit, saying there was insufficient evidence of environmental harm. She also ruled that the fireworks display did not require a coastal development permit as was claimed by the petitioners.
Latham & Watkins represented the La Jolla Community Fireworks Foundation on a pro bono basis. Click here for their brief.
