: Shelley’s CaseHats Off for Legal Analysis (LS Tidbits #12)
By shell
One of the most important skills to have as an attorney is applying legal analysis. Unfortunately, you will only catch a few glimpses in the appellate cases assigned in your casebooks. From time to time the judge may summarize the main arguments presented by each party, but this does not really provide the full picture of how an attorney applies legal analysis.
To get an idea of how legal analysis is done, go to Westlaw or LexisNexis and read the appellate briefs. Of course, there is no substitute for practice, so come up with your own fact patterns and see if you can apply the rules you have learned given the set of facts on hand.
