Dep't of Correction v. Cooper, OATH Index Nos. 2585/08 & 2586/08
Two correction officers were charged with filing false and misleading reports concerning an incident when another officer pushed an inmate down a flight of stairs. Video showed that the officer pushed the inmate down the stairs, yet both correction officers, who were stationed in a position to witness the incident, omitted that detail from their reports. ALJ Faye Lewis found the omissions to be deliberate and she sustained the charge.
However, Judge Lewis did not find the evidence sufficient to prove a charge that the officers colluded with each other, or other officers, to make sure that their reports were materially consistent. A 20-day and a 15-day suspension without pay were recommended as penalties.
