The Court has granted four petitions for certiorari:

  • Staub v. Proctor Hospital (09-400)
  • United States v. Tohono O’odham Nation (09-846)

The Court has also asked for the views of the Solicitor General in one case, Placer Dome v. Provincial Government of Marinduque (09-944).

There is a notable order in Holster v. Gatco (08-1307): the decision below is vacated and remanded to the Second Circuit in light of Shady Grove Orthopedic Associates v. Allstate Insurance Co. Justice Scalia concurs and Justice Ginsburg dissents, joined by Justice Breyer.
