A US District Court judge has ordered the DOJ to provide copies of OLC memoranda about domestic surveillance, so that the court can conduct an in camera review.  (How much you want to bet that the DOJ tries to take this up with the appellate court before complying?)    . . . .    The saga of the legal fees charged to Alice Lawrence, who's now dead, continues unabated.  We have allegations of unconscionable fees, suggestions that the deceased dodged her own deposition, and guarded skepticism from the appellate court about a large contingency fee.    . . . .     Daniel Markovits's new book, A Modern Legal Ethics: Adversary Advocacy in a Democratic Age, was mentioned at Larry Solum's Legal Theory Blog.    . . . .    A few of my Berkeley ethics students are skipping class (with permission) to work the election as lawyers-to-be.
