ADVERTISEMENTS

  • Overblown controversy?  A federal judge's new book is titled, "In Defense of Women: Unrepentant Advocate."  Does that make reasonable people doubt her impartiality in certain cases?  (Not me.)
  • From The Faculty Lounge: "Widespread Evidence Distortion Discovered in North Carolina Criminal Cases" Although the blame is being directed at the crime lab, the issue suggests that prosecutors may have an ethical duty concerning post-conviction relief.
  • In Baker v. State, the Oklahoma Court of Criminal Appeals took the prosecutor to task for playing "hide and seek," engaging in "gamesmanship," and failing to act as "an officer of the court."  There was a wealth of information to impeach the prosecution's key witness, and none of it had been turned over.  New trial granted.
  • In US v. Rivera-Corona, the Ninth Circuit clarified the standard for considering a defendant's request to discharge his privately retained lawyer and proceed instead with a court appointed lawyer.
  • Florida firms are pushing back against the proposed Florida Bar rules for web advertising.  The Rainmaker Blog piles on.
  • If you enjoy reading about the history of the profession, you might enjoy this short piece from William & Mary about St. George Tucker.
  • Jayanth Krisnan (Indiana) will be overseeing a major study of the Indian judiciary.
  • Two firms fought very hard -- and successfully -- to have small Rule 11 sanctions reversed. (h/t: ALM)
  • From ALM: An associate who was deferred and discharged has decided to sue the firm.  There's long been speculation about whether more suits like this would be filed.  It's often thought that associates would be loathe to generate notoriety, but this associate sees it differently.
