Legal ethics bits and pieces (August 19, 2010)

ADVERTISEMENTS

  • In GSI Commerce Solutions, Inc. v. Babycenter L.L.C., the Second Circuit affirmed a disqualification where the firm represented the adversary's parent corporation -- a fact patten that, to my surprise, the court said it hadn't addressed before.  (If I may, I'd like to point out that at page 13 the court cited my article -- which suggests, to my even greater surprise, that at least one human being has read it.)
  • When the Blagojevich indictment came down, we were critical of the public comments of US Attorney Patrick Fitzgerald (who has had a stellar career and who is held in high regard).  Main Justice looks back at those comments.
  • Squire Sanders successfully asserted a statute of limitations defense in a legal malpractice case against it in the bankruptcy court in Delaware.  Three years means three years.
  • At LegalWeek.com, Alex Novarese has a contrarian view: clients are not forcing sweeping changes on law firms.
  • From ALM: a specially appointed discovery master earned over $70,000 for the first three weeks of work, and one of the litigants is objecting.  (I suppose that in theory a retired judge can make a lot of money that way and would have a financial incentive to hold lots of hearings.)
  • Here's an interview with a Nigerian lawyer and publisher about the state of the profession there.
  • The British are coming (to the "high-yield bond market" in the US). (h/t: TheLawyer.)
  • From California Legal Fees Blog, here's news of a new Ninth Circuit decision on the timing of class counsel fees motions.  (The court wants to enable objections to the fees.)
  • From Australian Professional Liability Blog, is it grounds for termination if the client demands that the solicitor make hopeless arguments?
