Legal Ethics Items (November 4, 2010)

ADVERTISEMENTS
  • Washington Times: Review of a new book about plaintiffs lawyer -- and felon -- Dickie Scruggs.  (h/t: ABA Journal)  Interesting passage in the review: "Scruggs essentially was a businessman specializing in the mass marketing of personal-injury claims. He was not a trial lawyer because he didn't try cases."
  • ALM article about Bill Henderson's research and goals -- "Getting Beyond the Conventional Wisdom: A New Look at Firm Recruiting, Hiring, and Promotion."  (Disclaimer: I teach with Bill at IU and have long thought his approaches to thinking about human capital in law schools and in law firms are just about the best stuff out there.)
  • Cal Biz Lit says that the FASB rules on disclosing counsel's views on litigation will be sent back to the drawing board.  Good.
  • Conference: Empirical Professional Ethics, at St. Thomas, on November 6th.
  • Concurring Opinions runs a review by Adam Shinar of the new book edited by Austin Sarat and Nassar Hussain -- When Governments Break the Law: The Rule of Law and the Prosecution of the Bush Administration. [updated and corrected]
  • Above the Law: Simpson Thatcher threatens to withhold salary for delinquent time keepers.  (I didn't practice much employment and labor law, but I seem to remember that while you can monkey with a partner's draw, you'd better not touch any employee's salary.)
  • The Ethics Guru, about a new comment to the Virginia ethics rules: Prosecutors may advise police to communicate with represented defendant.
  • Jotwell: Christine Parker likes John Flood's new article, "Exposing the Regulatory Reform Agenda of Large Law Firms"
