By Michael Progar
Section 8(b) of the Illinois Workers' Compensation Act provides that the minimum TTD rate shall be not less than the higher of the Federal minimum wage or the Illinois minimum wage, multiplied by 40 hours. The rate is increased by 10% for each spouse and child.
Since the Illinois minimum wage is higher than the Federal minimum wage ($7.50 per hour as of July 1, 2007, vs. the Federal rate of $5.15 per hour), the minimum TTD rates are as follows for accidents occurring from July 1, 2007 through June 30, 2008:
- 0 children or spouse - $200.00
- 1 - $230.00
- 2 - $260.00
- 3 - $290.00
- 4+ - $300.00
