huh? on Beard v. Kindler

In light of Justice Alito recusing himself in Beard v. Kindler,  can anyone figure out why the Court granted cert in that case when the most likely result is 4-4 (hence affirming the panel’s decision below) or 5-3 for theAppellee.  Any insight would be appreciated.  The pro-government site C&C in this post suggests a similar befuddlement.
