Do I Have To Wait Six Months After I Take My First Consumer Credit Counseling Class to File My Bankruptcy?

By Joseph McDaniel, Esq.

ADVERTISEMENTS
No. You don't wait six months after you take your first consumer credit counseling class before you file.

Here's how it works.

You have to take your first consumer credit counseling class within the six months prior to filing.

Otherwise, that class is "stale", and you'll need to take another waste-of-time-that-you'll-never-get-back-class before we can file for you.

Then, right after we file, you must take waste-of-time-class-number-TWO, and make sure that Heidi the Bankruptcy Angel gets that so it can be uploaded to the Court, or you won't get your discharge.

Does it seem a little confusing and cumbersome?

Well, that's because it is!

Blame Congress for the 2005 Amendments, which were a solution in search of a problem.
