: North Carolina Appellate BlogFourth Circuit Banter On Suppression Of Evidence
By Sean E. Andrussier
ADVERTISEMENTS
This is off subject for this blog, but today's Fourth Circuit decisions include a very interesting dispute between Chief Judge Williams (writing the lead opinion) and Judge Gregory (dissenting) on the issue of "reasonable suspicion" in the context of a Terry stop -- and in particular whether a seasoned officer's hunch can satisfy that standard. The majority reversed the district court's suppression of evidence. (In another case today, a Fourth Circuit panel reversed a district court's failure to suppress evidence obtained as a result of a warrantless search of his apartment, holding that the search was illegal.)Full post as published by North Carolina Appellate Blog on January 25, 2008 (boomark / email).
