This story out of Wyoming should remind us that nondisclosure is the really significant issue in Senator Max Baucus's nomination of his girlfriend to be U.S. Attorney for the District of Montana.
In Wyoming, the very (and very justly) popular governor Dave Freudenthal submitted his wife Nancy's name on a short list of candidates for the open federal district court seat in Cheyenne. And President Obama has just nominated her for the seat.
Think too about Senior Judge Jane Roth of the U.S. Court of Appeals for the Third Circuit, who became first a U.S. District Court judge in Delaware and then a circuit judge while her husband Bill Roth was a sitting Senator from that state.
The real trouble with Baucus's move, it seems to me, was that he nominated his girlfriend without letting everyone know that they were in a relationship.
