Boumediene is out this morning. In a nutshell:
Guantanamo detainees do have a right to petition for habeas and the process for reviewing CSRT appeals provided by the Military Commissions Act is not an adequate alternative.
Yeah!
The 134 page decision breaks down this way:
- Kennedy's opinion (with Stevens, Souter, Ginsburg, Breyer)
- Souter concurring (with Ginsburg and Breyer)
- Roberts dissenting (with Scalia, Thomas and Alito)
- Scalia dissenting (with Roberts, Thomas and Alito)

post-script: as of 11:25 CST, MSNBC and Fox headline Boumediene, but apparently its not a big deal over at CNN where the story ranks fourth among "Recent News" headlines - behind an election poll, the influence of presidential spouses, and musings on Michelle Obama (which topped the list). The BBC, International Herald Tribune and al Jazeera give it top billing.
post-script II: oh for cryin' out loud, it 11:45 and CNN just dropped Boumediene to 5th place. Behind another Obama poll.
