You Thought You Had It Bad Department: Was That Half a Trillion Dollars? For ONE Category of Debt?

By Joseph McDaniel, Esq.

ADVERTISEMENTS
Recently battle lines have been drawn and people are choosing sides on a Bankruptcy Issue!

This is surprising to me because I'm a simple backwoods bankruptcy lawyer, and I seldom see big kids fighting about issues in my practice; I just toil in the shadows.

But the current hot topic in bankruptcy...not a top ten bankruptcy issue...but the Number One Bankruptcy Attorney Topic for the next few years is going to be this: will States be granted permission to file Bankruptcy?

Like any lawyer, I can find perfectly good arguments why they should not, and other arguments that go the other way. Lawyers are trained that way. At least, I think I was; it was a long time ago, after all.

But many of the arguments in favor of permitting bankruptcy by the insolvent States of the United States appear in this article.

Enjoy!
