Do SSP Standards of Professional Conduct Have Teeth? A Early Test and A Challenge

By John Darer

ADVERTISEMENTS

The Society of Settlement Planners ("SSP") adopted its Standards of Professional Conduct on March 7, 2008. Those standards are posted on the SSP website at www.settlementplanners.org

While there is much to be admired about the standards, standards are only as good as enforcement. If a professional association has a code of ethics and does not enforce its code then the credibility of that code is called in to question. Therefore, in an early test to show its mettle, the SSP is called out to enforce its standards over the activities of one if its members.

SSP member John Theodore Bair, is President of a company, Forge Consulting, LLC which continues to make the false and misleading statement that it is "the first major new firm in the structured settlement industry in more than a decade". Such false and misleading statement has been, and currently is, marketed on its website. It is further used in marketing to at least two state trial lawyer associations in advertising posted on those associations' web sites.

Rule 11 (a) of the Society of Settlement Planners Standards of Professional Conduct adopted on March 7, 2008 states in pertinent part "a settlement planner shall not make false or misleading statements about the planner, the services the planner is offering...."

SSP President Greg Maxwell and his leadership team should consider themselves publicly challenged to show that the Society of Settlement Planners means business with respect to enforcement of its "Standards of Professional Conduct"  in this early test with relation to SSP member John Theodore Bair.

GREG, THE INDUSTRY IS WATCHING!

Has the SSP Standards of Professiinal Conduct got this? or this?
