Jurors and the Internet

ADVERTISEMENTS

I've heard tales of litigants planting stories and buying Google keywords so that if jurors search they'll find stories that will hopefully sway the juror...

Related to that...  Texas is considering an amendment that would emphasize that jurors should communicate with anyone about the case outside the courtroom -- including the Internet.  An article and the proposed amendment are here.

Trial lawyers should consider asking for an instruction like this no matter where the venue.

Interesting question: if I buy keywords hoping a juror violates the rule am I communicating with the juror ex parte?
