Contracting with Commonwealth government agencies

By David Jacobson

ADVERTISEMENTS

From 1 November 2010 Commonwealth government agencies are required to take contractual measures to ensure that they receive documents held by certain contractors or subcontractors if a person requests access to documents under Section 6C of the Freedom of Information Act 1982 (the FOI Act).

The Office of the Australian Information Commissioner has published a model contract clause that will be required to be inserted into contracts between service providers and Commonwealth government agencies.

The new requirement applies to contracts entered into on or after 1 November 2010. It does not apply to contracts entered into before this time, even if the services under the contract do not commence until after 1 November 2010.

Dr James Popple has been appointed as Australia?s Freedom of Information Commissioner.
