And here's an article, Options for Student Borrowers: A Derivatives-Based Proposal to Protect Students and Control Debt-Fueled Inflation in the Higher Education Market, by Michael Macchiarola and Arun Abraham, suggesting that law students be able to contract around the risk of the cost of law school by selling futures on their own income. The idea is that the schools and lenders have perverse incentives, given that so many law school loans are non-dischargeable. More from ALM: ABA may push for more disclosure by law schools of about employment outcomes for graduates. As a former plaintiffs lawyer in the business tort field, it's my sense that if students and graduates could sue law schools for false advertising, Lanham Act violations, etc., the law schools and their deans would get slammed and would pretty quickly be more honest, if only out of self-protection.
