ADVERTISEMENTS
  • Strong v. Sutter County Board of Supervisors.  A county assessor had a beef with the Board and wanted independent counsel appointed in an expeditious manner.  In a split decision, the California Court of Appeal shot down the request and said that the assessor needed to file and succeed on a full mandamus action before counsel would be appointed.  The decision is technical, procedural, and statutory -- quite different than the usual case on conflicts and the law of lawyering.
  • Conglomerate: Christine Hurt looks at the prosecutors' over-reaching in the Enron-related "Nigerian Barge Case," which finally ended.  Prosecutors can be driven by fallacious sunk-cost thinking no less than lawyers in commercial litigation.
  • ABA Journal: plaintiffs bar less savvy about e-discovery.
  • Lawyerist.com: Should lawyers use Skype or Google Voice for their phone calls?
  • Deborah Rhode looks at "legal ethics on a global scale."
  • Wintergreen Partners v. McGuireWoods LLP: the Supreme Court of Virginia affirmed dismissal of a legal mal claim because the plaintiff couldn't prove that it would have won the appeal had the appeal been timely filed.
  • Legal malpractice behind the divorce of the couple that own the Dodgers?  The article says that of the various copies of the couple's agreement about ownership were not identical.
  • In re Adinolfi: the Second Circuit ruled that the lawyer could only maintain thirty cases at a time and had to take a law practice management class.
