ADVERTISEMENTS

  • Under a new Seventh Circuit decision, US v. Williams, district courts must make inquiry whenever a defendant complains about his/her attorney.  (h/t: Wisconsin Law Journal)
  • This new unpublished opinion, State v. Smith, from the California Court of Appeal illustrates the difficulties, frustration, and confusion that can ensure when an accused exercises his right to represent himself.  The case doesn't make new law, but the factual narrative provides an insight into the world of state trial-level criminal law.
  • This new unpublished decision, Pursley v. Phillippe, should have been published.  It deals with a conflict arising from non-legal work by an inactive member of the bar who had worked as an insurance adjuster on the defense side.  The trial court denied defendants' motion for DQ and the appellate court affirmed.
  • The Supreme Court of South Carolina, in The Matter of Crews, disbarred an attorney who used a power of attorney to loot clients' assets.
  • Eric Rucker, the top administrator in the officer of former Kansas Attorney General Phill Kline, will be informally admonished for failing to correct the factual record after learning that his statement to the court was inaccurate.  The matter concerned the alleged efforts of the Attorney General to obtain the names of women seeking abortions.
  • From the State Bar of Wisconsin: ethical considerations when leaving a firm.
  • From Main Justice: a nice summary of the Blagojevich conviction and retrial.
