: Legal Pad | LASmith's FCPA sentencing postponed for the fourth time
By Richard Binder
Former Pacific Consolidated Industries LP executive Leo Winston Smith pleaded guilty last year to conspiring to pay $71,000 in bribes in the United Kingdom to a Defense Ministry official so that PCI secure Royal Air Force contracts worth some $11 million. He faces up to eight years in prison, but his sentencing has been postponed for the fourth time.
Apparently, Smith joins a list of people convicted under the Foreign Corrupt Practices Act who are still waiting to be sentenced, including two executives from American Bank Note Holographics who were convicted in the 2000s.
Smith's attorney, Edward Patrick Swan Jr., a partner at Luce, Forward, Hamilton & Scripps LLP in San Diego, declined further comment on the case until his client is settled.
