: National Eminent Domain BlogWhy you need to be careful what you say
By Alan Ackerman
In a recent West Virginia State Journal article, a property owner, who you would otherwise feel for, claimed that something extra should be paid because her family had retained the property for 100 years. However, negating any sympathy, the following article notes that the property was marketed two years ago, before the condemnation for the airport expansion was known. The owner looks foolish.
In this case, the reality is the Airport Authority has no funds as of yet to move forward with an acquisition.
At least the owner finally got her name in the paper!
The State Journal
Judy McNemar says her family has lived off of Route 131 for more than 100 years.
"It means a lot to us because we've been here so long, and it's family roots," said McNemar.
The North Central West Virginia Airport sits just over the hill behind her property. In 2008, Mcnemar says she had her house on the market to sell when she found out that the airport had plans to expand their runway, plans that included taking her property.
"Consequently, no one wants my property because they would be taking a chance on what the airport would eventually give them for the property," said McNemar. "I can't afford to move and I can't go and buy some more property because I don't know how much money I have to work with…I can't go and buy property that I don't know if I can afford."
