: Legal Pad | LAThree-year-old suit against Miwoks finally going to trial
By Richard Binder
The Shingle Springs Band of Miwok Indians and former partner Sharp Image Gaming may be going to trial this fall.
The Miwoks ran a small gambling hall with Sharp Image before it opened Red Hawk Casino in 2008. Sharp Image argues that the tribe broke its contract with the company when it teamed up with Lakes Entertainment Inc. to open Red Hawk. The gambling-device supplier claims it's owed $107 million, including $100 million in potential profits they say they lost when the Miwoks broke their contract.
The tribe fought the suit, filed three years ago in El Dorado Superior Court, on grounds of sovereign immunity, the legal doctrine that says Indian tribes generally can't be sued. Last week the California Supreme Court denied the appeal to dismiss.
