His column in today's Houston Chronicle is,"Best clue: The case of the erotic candy."Former Gov. Mark White has joined 20 former judges and prosecutors and 30 legal ethicists in asking the U.S. Supreme Court to tell the Texas Court of Criminal Appeals the obvious:That a judge who secretly slept with a district attorney can't preside over a death penalty case personally tried by the district attorney.The Supreme Court has not yet agreed to hear the case, but I predict it will.With all due respect to White and the other luminaries who last week filed briefs imploring the high court to take up the issue, my prediction is based less on their arguments than on a January ruling by the Supreme Court in another death penalty case.This one didn't involve a judge, a prosecutor and their sexual affair...continue to full post
