Tweaking lethal injection: new scholarship

By Karl R. Keys, Esq.

ADVERTISEMENTS
Ty Alper’s What Do Lawyers Know About Lethal Injection?, 1 HARV. L. & POL?Y REV. (Online) (March 3, 2008)  examines one of the mystifying questions in lethal injection litigation, WHY haven’t states simply changed their procedures?  Alper’s work looks at one small piece of that puzzle, how states have attempted to use the attorney-client privilege, often in clearly erroneous ways, to hide the process of how the current lethal injection regimes were adopted. It is a quick read, gives a great take of life on the lethal injection front lines,  and is a must read for anyone who wants to know how bureaucracies fight to prevent the discovery of their mistakes.
