Malpractice Lawsuit Filed Against W.Va. Surgeon

A West Virginia family has filed a malpractice lawsuit against Charleston Area Medical Center and Dr. Robert W. Letton Jr., alleging Letton violated his duty to operate on an infant female ?within an acceptable standard of medical care.? According to the lawsuit, Letton lacerated the spleen of infant Savannah Lovejoy during surgery in December 2005, causing her severe injury, pain and suffering. The family is seeking damages for negligence, medical malpractice, battery, medical malpractice via agency and loss of consortium.
