: The GavelDetainee Seeks End to Tribunal System
By Peter Hardin
A Guantanamo Bay, Cuba detainee who faces war crime charges before a military commission has asked a civilian court to throw out the new military tribunal system set up by Congress.
Mohammed Kamin, an Afghan detainee, made his request to the D.C. Circuit Court, according to an article by SCOTUSBlog. His lawyers contend that Congress lacked authority to set up the military tribunals as they currently stand, and that the system violates the Constitution, the “law of war” and the “law of nations.” The blog post offers links to Kamin’s filings and a response by the government.
