Jury Apportions Liability In Wrongful Death Trucking Accident Case

ADVERTISEMENTS

Georgia injury lawyers know that the causes of multi-vehicle tractor trailer accidents are often complex, especially when the collision results in the wrongful death of one of the drivers. This was the case in a trucking accident involving 2 trucks and a commuter van that occurred on October 12, 2007. A truck being driven by Steven Bogue left Georgia and headed south on Interstate 75. As Bogue approached the U.S. 441 exit, where rescue workers were cleaning up after an earlier fatal collision, he rear-ended another truck which then struck a commuter van. Bogue died and others in the van were injured, including one woman who reportedly sustained a traumatic brain injury. Bogue?s estate filed a wrongful death lawsuit against multiple parties and the case was tried before a jury on the issue of liability only. The Gainesville Sun http://www.gainesville.com/article/20090904/ARTICLES/909049940/1002/news reported on the case and the trial on Friday that the jury took just two hours to decide which of the parties were negligent and assigned a percentage of responsibility to each. Interestingly, the jury found the plaintiff, Bogue to have been 15 percent at fault, the commuter van and the Alachua police department each 35 percent at fault and the driver of the truck that Bogue struck 15 percent at fault.
