Different Elements of Medical Malpractice

By Oguz Ozdemir

ADVERTISEMENTS

What exactly is medical malpractice? It is when a physician or health care professional acts negligently while treating a patient for a medical condition. It is a result of an action or inaction and the effect that result from it.

One of the three top causes is failure to diagnose a condition. Misdiagnosis is if a condition is not properly evaluated so that the correct treatment can be provided. A delayed diagnosis can result in serious side effects including death. If an illness or medical condition is undiagnosed too long the condition could escalate beyond repair.

A doctor may be liable for medical malpractice if he does not provide the patient with informed consent. This means that the statistics and possible side effects must be disclosed to the patient so that he or she can make an informed decision as to how best to proceed.

An attorney will evaluate your case to see if your circumstances qualify for a medical malpractice law suit. If you can prove negligence and you suffered directly as a result of this negligence you have a good chance of pursing this line of action. However if you did not suffer any side effects or damages it would be hard pressed to pursue this any further.

If your attorney does feel that you have cause to collect compensation for the effects of another person's negligence be prepared. You are in for a long ride so be patient and make sure that you provide your attorney with all the ammunition that he or she needs to complete this case successfully.

Medial malpractice cases take a lot of time and money to carry out. Professionals must be brought in to verify facts and provide depositions, medical records must be tracked down and the physician's malpractice insurance is going to fight all the way. Some people mistakenly think that they can settle their own malpractice suit and are tempted if they are approached to settle fast by a hospital or other defendant in the case.

You are smart to save yourself a lot of time and money right up front and find yourself a professional law team who already know all of the ins and outs of medical malpractice. Most attorneys will give you a free consultation and evaluate your case right up front. Because these cases do take a lot of time and are costly and attorney will not take your case if he or she does not think they can settle for a decent amount. The amount will need to cover their legal fees, out of pocket expenses and compensation for your time and injuries.

Call the law firm of Napoli Bern Ripka today at 1-888-LAW-IN-NY for a free consultation. It doesn't cost a thing to find out whether or not you have a case.
