: Kentucky Law BlogCOURTS: Jury selection in western Ky. murder case to be closed
By Michael Stevens
From Herald Leader. I am printing this story en toto as the defense attorney Jim Gibson is a former Army Judge Advocate I served with many years ago when both of us were soldiers once, and young.
A judge has ordered jury selection closed in the case of three people charged with raping and killing a western Kentucky teenager.Graves Circuit Judge Tim Stark said the courtroom will be closed while attorneys question members of the jury pool for the trial of three people charged with killing Jessica Currin in July 2000.
Prosecutors said they will seek the death penalty for Quincy Omar Cross, 31, of Tiptonville, Tenn.; Tamara Caldwell, 27, of Mayfield; and Jeffery Allen Burton, 27, of West Paducah, if they are convicted of kidnapping, raping and murdering Currin.
A trial for the three is scheduled for March 3.
Caldwell's defense attorney, Jim Gibson, asked Stark on Friday to set aside the death penalty for his client because of questions about whether she is mentally retarded. Gibson also asked Stark to set aside the death penalty because of the U.S. Supreme Court's ongoing review of lethal injection methods.
