SIMPLICITY THE KEY TO PROPOSED SUPER LAWYERS RULE CHANGE
"A state Supreme Court committee on lawyer ethics is recommending a simple nine-word change in the rules of professional conduct to make it legal for New Jersey lawyers to advertise their inclusion in Super Lawyers, Best Lawyers in America or other rating publications. The committee wants the Court to modify the ban in RPC 7.1 on ads that compare one lawyer's services with others to allow comparisons that can be substantiated. A proposed comment suggests that disclaimers or disclosures in the ads might be necessary to keep an ad from being misleading, but the committee stopped well short of dictating what disclosures or disclaimers might say."
MONMOUTH LAWYERS, RETIRED JUDGES TO MEDIATE ON FURLOUGH DAY
"When the courts shut down on June 29, the second of two planned state furlough days, Monmouth County lawyers will still be able to dispose of some cases if they want to. A county bar program will make available a dozen trained, experienced mediators, including retired Monmouth County Superior Court Judges Alexander Lehrer and Robert Feldman and 10 lawyers who have signed up so far, at no charge to help lessen any court delays caused by the time-out. The progam, dubbed "Court Alternative Day," will be available for civil and family cases pending in the county but will not be held on court premises or under court auspices."
TICKETMASTER SUBSIDIARY'S PRICE GOUGING IS RAMPANT, SUIT SAYS
"February's scandal over scalping of Bruce Springsteen tickets has led to a class-action suit in federal court in Trenton, alleging that Ticketmaster routinely diverts online purchasers to a higher-priced vendor that it owns. The suit comes two months after New Jersey's attorney general entered a settlement with Ticketmaster to resolve more than 2,000 consumer complaints about Springsteen shows in the Meadowlands. The settlement provided tickets or gift certificates for the complaining fans, but the new suit charges the practice is far more widespread, involving concerts of other popular artists ? among them Britney Spears, Mylie Cyrus/Hannah Montana, Phish, Radiohead and the Grateful Dead."
SETTLEMENT REMOVES CONFLICTS FROM CLINICAL TRIALS
"The North American unit of a Swiss medical-device maker agreed Tuesday to stop paying clinical-trial doctors with stock and options and to disclose how they are compensated. Attorney General Anne Milgram said the compliance agreement with Synthes Inc. of West Chester, Pa., resolved allegations that some doctors conducting clinical trials of its ProDisc Total Replacement System had a financial stake in the outcome. The specific products, ProDisc-L and ProDisc-C, have received federal Food and Drug Administration approval for use on people with degenerative disc disease. The company agreed to disclose the names of clinical-trial doctors, to determine whether there are conflicts if it purchases another company, and to create a standard operating procedure within 90 days to ensure compliance."
COST-CUTTING CLIENTS PUT THE SQUEEZE ON LAW FIRMS
"It doesn't take an oracle to predict that in a recession, clients would look to trim legal costs. But clients and lawyers alike say that what is happening now is more of a Freddy Krueger-style bloodletting, The American Lawyer reports. And litigators, traditionally thought of as safe from recessionary pressures, are feeling it, too. Clients are demanding deep discounts, creating incentives for litigators to resolve cases quicker, keeping more lawsuits in house, and even shedding longtime counsel. The results: associates are being purged en masse, profits are down, and perks once taken for granted are now being watched with an eagle eye."
