Billings v. Town of Grafton, No. 06-2145. In this case the First Circuit remands after summary judgment in a sexual harassment and retaliation case. This case catalogues a number of instances of breast-staring by someone with "alternating intermittent exotropia" (according to testimony). There are a couple of twists, such as the plaintiff accidentally opening mail from the a defendant?s lawyer. The procedural history is rather complex, but the First eventually concludes that hostile environment sexual harassment doesn?t require "overtly sexual comments to or about [the plaintiff.]? and that a transfer was resulted in the plaintiff doing a less prestigious job.
