: Bodily Injury BlogState Court Approves ?Light? Cigarette Lawsuit

The Massachusetts Supreme Judicial Court has rejected arguments from Philip Morris that a 1965 federal cigarette law pre-empts state laws against deceptive marketing. In a unanimous ruling, the state?s highest court cited a December U.S. Supreme Court ruling in which the justices found that consumers may pursue lawsuits involving the marketing of so-called light cigarettes. The ruling clears the way for a class of smokers to pursue claims that the Virginia-based company engaged in deceptive marketing.
