The Ethics of State Ethics Sites

ADVERTISEMENTS

I try -- try -- to keep my list of links to state ethics rules and state ethics opinions on hricik.com up to date, and so every year or so -- sooner if I have time and inclination -- I check the links. Each year, many change because bars update their pages, which makes work for me.  So, I write in "anger" after having spent 2 full hours going through the links and updating them.. but that's not why I write.

I write because some states, as well as the ABA, make their ethics opinions "members only."  That seems quite wrong to me given the public notice function that opinions are supposed to serve.  Now, granted the ABA has a copyright/revenue argument, and its opinions are not binding on anyone, but it seems to me inexcusable for a state bar to make opinions inaccessible to, at minimum, nonlawyer citizens of the particular state.

That's my rant, and I'm sticking to it.
