: Thoughts from a Management LawyerHuman Rights and Hockey in the News
By Michael Fitzgibbon
Though not a labour or employment case, it's tough this time of year, to pass up a human rights and hockey story.
I draw your attention to The Manitoba High Schools Athletic Association Inc. v. Pasternak et al where the Court upheld an adjudicator's decision that, in the circumstances, two female students were discriminated against when they were denied "the opportunity to try out or to complete the try-out process for the men?s team and, consequently, were denied the chance to be judged on the basis of their personal merit". The Court also agreed that there was no "bona fide and reasonable justification for the prima facie discrimination".
A summary of the case can be found here.
This is an interesting case that covers a tremendous amount of ground.
