Dep't of Correction v. Givens, OATH Index No. 393/09 (Dec. 29, 2008)
Source: OATH determinations
ALJ Casey recommended termination for correction officer Vera Givens who was absent from work for more than 135 days in a 14-month period in 2007 and 2008. The respondent claimed that most of her absences were the result of work-related injuries, including an altercation with another officer and a slip-and-fall in a Department facility.
However, under the Civil Service Law and the Department's sick leave policy, excessive absenteeism may result in termination even if due to verified or work-related injury.
