The Gun Trust Niche

By Chuck Newton

ADVERTISEMENTS

I want to continue to bring to you different or unusual legal niches so you can clearly see that law is much more than a few broad categories.  In this regard, lawyers continue to amaze me with their ingenuity in discovering, isolating, marketing and making profitable legal niches for themselves.

Clue_Guns_Pack One such person is David M. Goldman of Jacksonville, Florida who has created a sub-practice in drafting and implementing NFA Gun Trusts.

There is a particular classification of guns and paraphernalia, such as silencers, that are heavily regulated by the government.   These are referred to as Title III or class 3 firearms or weapons.  These regulations often require fingerprints and CLEO sign off, and the technical mishandling of the firearms can result in jail of up to 10 years and fines of up to $250,000.00.  It is important for gun enthusiast to protect both themselves, but their families and estates as well from such liability.

For David Goldman this includes the NFA Gun Trust.  It is essentially a revocable trust, with a number of modifications, that is only used to facilitate the holding, buying, selling and transfer of these classification of firearms both presently and after creator of the trust has passed.

Other benefits of the NFA Gun Trust is that the Trust may acquire class 3 weapons without the need for fingerprints or CLEO sign off.

For a flat fee David Goldman drafts these trust to fit the particular needs of the person ordering it trust; produces a memorandum discussing the commonly asked questions regarding NFA and ATF regulations; and, instruct the trustee on how to make purchases correctly, as to who can and cannot use the weapons, and now to avoid technical violations which can be costly.

David Goldman produces approximately 1,000 such trusts a year.  And, he collaborates with over 40 lawyers around the country to assist people with these trusts in most states.

What this shows us is that "Jiffy Lube model" of practice is all about us, if we will just look for it.
