As you know, in 2005, Congress passed an amendment that will implement the opt-in system for a faster review of state capital cases in federal courts. The amendment requires of U.S. attorney general to review whether states are providing counsel to capital defendants. With the review of the attorney general’s decision and the D.C. Circuit Court, the state of Arizona will probably be interested in submitting such a petition for review. If you are confirmed as attorney general, will you review the state of Arizona’s application in a timely manner and make a timely determination of whether Arizona is providing counsel to capital defendants and post-conviction review?
